Practice Areas

Six fronts, one approach.

We don't organize our services by area of law, but by problem and sector — that's how our clients actually need to find answers.

Health & Pharmaceuticals

We advise laboratories at every stage where a patent can affect a product's access to market. We analyze the validity and scope of patents and applications, prepare third-party observations and office-action responses before the INPI, assess freedom to operate ahead of a launch, and represent our clients in nullity and infringement litigation, including interim injunctions. We pay particular attention to applications covering crystalline forms, salts, combinations, dosages and new uses, where the patentability analysis requires familiarity with both local examination guidelines and comparative practice. We integrate this work with regulatory strategy before ANMAT, since in the pharmaceutical sector patent terms and marketing-authorization timelines condition one another.

Agriculture, Seeds & Agrochemicals

We work with trade associations and agribusiness companies on the protection of plant varieties, the relationship between the plant breeders' rights regime and the patent regime, and the position of generic agrochemical formulators. We analyze the consequences of regulatory changes under discussion, such as Argentina's potential accession to the Patent Cooperation Treaty (PCT) or the adoption of the 1991 Act of the UPOV Convention, and prepare technical reports and position papers for submission to the Legislature and the competent agencies. We support proceedings and disputes before the INPI and the INASE.

Technology, Software & Trade Secrets

We advise software and technology companies on identifying and protecting their intangible assets, with a focus on trade secrets and know-how, which are typically these companies' main assets and the least protected. We design the contractual architecture with clients, suppliers, business partners and employees, draft licenses and technology transfer agreements, and define internal confidentiality and IP-ownership policies. We also address the issues raised by artificial intelligence, including ownership of outputs, the use of training data, and the tension between secrecy and explainability requirements.

Public Policy & International Affairs

We advise ministries, public agencies and international organizations on designing and evaluating intellectual property, public health and innovation rules and policies. Our work includes the use of TRIPS Agreement flexibilities, the relationship between intellectual property, access to medicines and human rights, and the preparation of documentation for international review processes.

Technology Intelligence

We produce patent landscape studies, state-of-the-art reports and technology watch services for companies, trade associations and institutions. These studies make it possible to identify who is patenting in a given sector and where, detect freedom-to-operate opportunities for developing new technology, anticipate conflicts with third-party portfolios, and ground public-policy decisions in data. Each study is delivered with a scope defined in advance, the search methodology used, and conclusions oriented toward the decision the client needs to make.

Startups & Technology-Based Companies

We support startups and technology-based companies from their earliest stages, when intellectual property decisions are cheapest to make and most costly to correct later. We sort out ownership of developments among founders, employees, contractors and originating institutions — a critical issue for ventures spun out of universities or the public science system — and negotiate transfer or license agreements with those institutions. We define what to protect by patent, what to keep as a trade secret, and which trademarks to register, and plan filings abroad within the priority deadlines of the Paris Convention, bearing in mind that Argentina is not a party to the PCT.
